Photography Agreement

PHOTOGRAPHY AGREEMENT:
This agreement contains the entire understanding between Lucidaré Studio and the client. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all parties. In the event that any part of this agreement is found to be invalid or unenforceable, the remainder of this agreement shall remain valid and enforceable. Any agreement to waive one or more provisions of this agreement or any failure by one or both parties to enforce a provision of this agreement shall not constitute a waiver of any other portion or provision of this agreement.

RESERVATION:
A signed contract and a 50% non-refundable retainer fee are required to reserve the date and time of the photo session. If the photo session is rescheduled, postponed, or cancelled; or if there is a breach of contract by the client, the retainer fee is non-refundable and shall be liquidated damages to Lucidaré Studio.

PAYMENT SCHEDULE:
The aforementioned 50% non-refundable retainer fee is due at the time of signing of agreement and required to secure your photo session date and time. Your date is not secured until the 50% retainer fee is received. The remaining balance is payable in full prior to or the day of the photo session. In the event the client fails to remit payment as specified, Lucidaré Studio shall have the right to immediately terminate this agreement with no further obligation, and retain any monies already paid.

Returned checks will be assessed a $70 non-sufficient funds fee.

RESCHEDULING:
Lucidaré Studio requires at least a 48-hour notice, acknowledged by Lucidaré Studio, to reschedule before your scheduled session start time. If you fail to provide 48-hour notice, monies paid by the client will be non-refundable and you will forfeit your session deposit.

If Lucidaré Studio cancels your photo session and cannot reschedule within 90 days, your deposit will be returned in full.

LIMITE OF LIABILITY:
In the unlikely event that your digital photograph files are lost, stolen, or destroyed beyond the control of Lucidaré Studio prior to the delivery of your final images, the liability is limited to the return of all payments you have made to Lucidaré Studio. The limit of liability for partial loss of digital media/originals shall be a prorated amount of the exposures lost based on the total number of originals.

CAPTURE AND DELIVERY:
Lucidaré Studio is not liable to deliver every image taken at the session. The determination of images delivered to the client is left to the discretion of Lucidaré Studio.

POST-PRODUCTION AND EDITING:
The final post-production and editing styles, effects, and overall look of the images are left to the discretion of Lucidaré Studio.

BEAUTY PRACTICES:
Due to the nature of our photography, it is very critical that you perform safe and smart beauty routines and practices prior to your session, and be aware that your makeup face tone matches your neck and body skin tone. We are not responsible if your face makeup color does not match skin tone in final edited photographs or if there is a distinct line from face to neck skin tone. We are not responsible for removing skin imperfections caused by beauty practices or personal health and hygiene. We will do our best in editing if there is a slight skin tone variation or small blemish. In extreme cases that require additional editing time other than what is included in your package, an editing fee of $50 per hour will be required. Lucidaré Studio will calculate this fee, and full payment is required prior to editing.

SOCIAL MEDIA & INTERNET SHARING POLICY:
If posting any photos taken by Lucidaré Studio during your photo shoot on social media sites and apps, websites, or personal blogs, we require that you use the Lucidaré Studio watermarked digital photo file versions provided with your downloads file.
